Act of Incorporation and By-law
CMPA was founded at the annual meeting of the Canadian Medical Association in August 1901.
CMPA was incorporated by a special Act of Parliament. The Act of Incorporation for The Canadian Medical Protective Association was passed by the House of Commons on February 27, 1913, and assented to on May 16, 1913.
The Act of Incorporation empowers the Association to establish rules to guide the conduct of its affairs. These rules are embodied in the CMPA By-law.
Since the Association's incorporation, the by-law has been revised as required.
The most recent review of the By-law took place in 2024-2025. The new By-law 53 was approved by CMPA members at the CMPA Annual Meeting on August 20, 2025. As CMPA was created by an Act of Parliament, By-law 53 requires an Order from the federal Cabinet before it can go into effect. We are currently seeking Cabinet approval. While we wait, CMPA continues to operate under By-law 52.
